Land Use/Zoning
Land use and zoning involves changing the zoning of land for higher
and better uses, as well as obtaining approvals for uses on zoned
property which require additional permits to operate.
Rezonings involve applying to change the zoning
classification of land to allow different density and/or uses than
permitted by right under the existing classification.
Even if the zoning classification is appropriate, certain
uses are deemed to have additional or other impacts which require
more regulation.
In such instances, a special use permit may be required.
In certain cases, a proposed use or structure does not fall
neatly within the Code or regulations, including definitions, and an
interpretation of the use and whether it is permitted by right or by
special use permit must be obtained. At other times, regulations and
Code provisions have changed, and the question must be answered as
to what uses are permitted and whether the changed provisions apply (whereas a use is vested). In other cases, approved proffer
statements must be interpreted to determined whether later plans are consistent and may be approved. In these instances, interaction with Planning Office and Zoning Administration Staff, as well as with the County Attorney's Office, may be required. |
